Our Privacy Philosophy

Evolucion Innovations, Inc., EVO COLLECTIVE, LTD, and WHISTLER VILLAGE SPORTS LTD. (collectively “evo Hotel”, “we”, “us”, “our”) is committed to protecting the privacy of our customers and site visitors. This Privacy Policy explains how we collect, use and disclose information about you when you access and use our websites, mobile applications and other online products and services (collectively, “Services”), or when you otherwise interact with us, such as in our stores or through our customer support channels  The Policy also sets out how you can make a request  to exercise any rights regarding this information.


Collection of Information

Information You Provide to Us

We collect information you provide directly to us. We collect information when, for example, you create an online account with us, sign up for notifications or updates, subscribe to our newsletter, purchase or rent from us, enter contests, participate in promotions and events we sponsor or otherwise provide us information about yourself. The type of information we may collect includes your name, postal address, e-mail address, phone number, social media username(s), and any information you may share about your interests and preferences.

Transaction information. The information we may collect includes account information as well as your credit card information and transaction history. If you make a purchase, we work with a third-party payment processor to collect and process your payment information.

Promotional and event information. We may collect information related to evo Hotel events and sponsored trips including, health & fitness information, activity proficiency, dietary requirements, gender, social handles, and emergency contact information among other things.

Personal and professional information. We may collect information related to a job application including resume information, past work history, contact information, references, and any other information you choose to provide in your application.

User Content. We may collect other information or content you provide to us, such as when you review products, participate in surveys, or provide feedback via care or the website.

Information We Collect Automatically or From Third Parties

We may also automatically collect information about you when you access or use our Services. Automatically collected data may include:

Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.

Device and Usage Information: We collect information about how you access and use our Services, including information about the device and network you use, such as browser type, access date, access time, IP address, hardware type/model, unique device identifiers, mobile network, app version, operating system and browsing history. Location Information: In accordance with your device permissions, we may collect information about the precise location of your device. You may stop the collection of precise location information at any time (see the Your Choices section below for details).

Information Collected by Cookies and Similar Tracking Technologies: In addition, we (and those who perform work for us) may use cookies, web beacons, and other tracking technologies to collect information about you and your interaction with our Services, including information about your browsing and purchase behavior on our website and other interaction with our Services. A cookie is a tiny element of data that our site sends to a user’s browser, which may then be stored on the user’s hard drive or in device memory so that we can recognize the user’s computer or device when they return. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address or infer that you are looking to purchase certain products based on your browsing behavior and past purchases.

Use of Information

The information we collect is used to process your requests or transactions and to provide you with the Services. We may also use the information we collect to:

  • Provide, maintain, improve, and develop new products and services, including to debug and repair errors in our Services;
  • Personalize your experience with us;
  • Send you technical notices, security alerts, support messages and other transactional or relationship messages. For example, we may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance;
  • Communicate with you about products, services, and events offered by evo Hotel and others and provide news and information that we think will interest you;

  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;
  • Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of evo Hotel and others;
  • Comply with our legal and financial obligations;
  • Create de-identified, anonymized or aggregated information; and
  • Carry out any other purpose described to you at the time the information was collected.

Disclosure of Information

We disclose personal information in the following circumstances or as otherwise described in this policy:

  • We disclose personal information to vendors, service providers, contractors and consultants that access personal information to perform work for us, such as companies that assist us with web hosting, payment processing, fraud prevention, customer service, advertising, and marketing services. We may provide to third party service providers certain information that is necessary to fulfill an order you have placed with us. For example, if you request shipment for a purchase, we may provide your address to the shipping carrier, and if you pay by a credit or debit card, your card number and sales transaction information are passed on to the card processor and/or issuer (including their service providers such as fraud verification services).
  • If you provide a product review or otherwise share content on our Services, we disclose this information publicly and to other users of our Services.
  • If you choose to use integrations we offer on our Services, such as sharing your location through our Google Maps integration, we may disclose certain information with the integration partners.
  • We disclose personal information with third parties for their own services and marketing purposes in accordance with applicable law.
  • We disclose personal information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • Personal information is disclosed between and among evo Hotel and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.

  • We also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

When you participate in the interactive areas of our Services, such as chat rooms, forums, message boards or news groups (if any), certain information about you may be displayed publicly on our Services and on third party sites, such as your photos, posts, and other information you choose to provide in your profile or during that session. We do not routinely monitor or retain logs or copies of these interactive areas, if any, that may be available on our Services. However, you should be aware that your use and disclosure of any information in these areas is governed by our Terms of Use.

We may also provide access to data that includes your personal information as an asset in connection with the contemplated or actual financing, securitization, insuring, merger, sale (including transfers made as part of insolvency or bankruptcy proceedings) or other encumbrance, divestiture or disposal of all or part of our business or assets, including for the purposes of determining whether to proceed with the transaction or fulfilling any records or other reporting requirements to relevant third parties. Social Media Sharing Features

The Services may offer social sharing features or other integrated tools, which let you share actions you take on the Services with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the third party providers of the social sharing features you select. Your use of any social sharing features offered by the Services is governed by our Terms of Use and this Privacy Policy. Children's Privacy

Our Services are neither developed for, nor directed at, children under 16 years old. We do not knowingly collect information from any person under the age of 16. Our Services may contain links to third-party owned or operated websites. When you access these external websites, the providers of the websites, which may include product or service vendors and other unrelated parties, may have access to certain information about you. Please be aware that once you have left our Services, we are not responsible for the privacy practices or the content of any websites that we do not control directly and the collection, use and disclosure of information about you by these entities will be subject to the privacy policies applicable at those other websites.

Your Choices

Internet Technologies Used.Cookies, web beacons and other relevant Internet technologies are used on our Services to allow us to accomplish the uses set out in this Privacy Policy as well as to deliver Service messaging and to keep track of your information. These small pieces of program code or “files” reside on your computer hard drive and browser and can be removed. If you desire to remove the technologies you may do so, but this may render our Services unusable to you. You can opt out of cookies or the other Internet technologies used by disabling these features in your browser program. Location Information. You also have the ability to turn location-based services on and off by adjusting the settings of your Internet browser or mobile device, or by following the standard uninstall process and removing all evo Hotel applications, if any, from your mobile device.

Analytics Partners. We use analytics services such as Google Analytics. California law requires that we provide transparency about personal information we "sell," which for the purposes of the CCPA broadly means scenarios in which we have shared personal information with partners in exchange for valuable consideration.

While we do not provide personal information about you to other companies for money, we do allow certain advertising and analytics partners to collect identifiers, commercial information and Internet or other electronic network information via our Services to show you ads that are targeted to your interests, and these disclosures may be considered “sales” as defined by California law. These partners are further described in the Third Party Advertising, Analytics and Services section of this Privacy Policy. We do not sell personal data of individuals we know to be under 16 years of age.

Notice of Financial Incentive

We offer product incentives to prospective and current evo Hotel users. Sometimes, consumers sign up in order to receive product incentives. As such, under the CCPA, our product incentives may be considered financial incentives provided in exchange for the collection and retention of personal information.

We offer these product incentives to enhance our relationship with you. There is no obligation to opt-in and consumers may opt-out at any time. The details of each program are contained in each such program offering.

The consumer data received in exchange for your participation is dependent on several factors, including, for example, whether and to what extent you take advantage of any offerings and whether and to what extent you opt out of any offerings but is roughly equivalent to the value of the product offered.

Retention of Personal Information

You may only make a verifiable consumer request for access or data portability twice within any 12 consecutive-month period. The verifiable consumer request must:

We are based in the U.S., and if you are visiting the site from outside the U.S., please be aware that information we obtain through the site or our Services may be transferred to, processed, stored and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence.
